Art. 1 — A deceased person's voice is not property

WIR does not consider a deceased person's voice as property in the traditional sense. Voice is an intimate element of identity and memory. WIR strictly regulates any vocal reconstruction to prevent abusive, deceptive, commercial, or dignity-violating use.

Art. 2 — Purpose of the service

Voice reconstruction is offered solely for personal, family, or intimate memory purposes. Its goal is to preserve a vocal and emotional trace of a deceased person — not to claim to revive them, speak in their real name, or create confusion with a living person.

Art. 3 — Private use only

Voice reconstruction is authorized only for strictly private, personal, and non-commercial use. The user may not publish, broadcast, sell, publicly share, or integrate the reconstructed voice into any commercial content, film, advertisement, social media, or public medium without specific and verifiable authorization.

Art. 4 — User responsibility declaration

The user declares to be a legitimate relative of the person concerned and certifies using voice reconstruction only in a private and respectful context. They guarantee not to use the service to deceive third parties, usurp the deceased's identity, or generate content that is humiliating, defamatory, political, commercial, sexual, violent, discriminatory, or contrary to their memory.

Art. 5 — No property claim

Using a reconstructed voice grants the user no property rights over the voice, image, personality, or memory of the person concerned. WIR transfers no property rights over a deceased person's vocal identity.

Art. 6 — Family consent and no known objection

When the deceased person gave no explicit authorization during their lifetime, the user declares having no knowledge, as of the creation date, of any objection expressed during their lifetime or any current objection from a direct relative. When in doubt, WIR recommends obtaining the agreement of direct relatives before any creation.

Art. 7 — Challenge by a direct relative

In the event of a serious challenge by a direct relative, WIR reserves the right to temporarily or permanently suspend the reconstructed voice while reviewing the request within 30 days. In case of manifest family conflict, WIR may delete the voice reconstruction to protect the memory of the person concerned.

Art. 8 — Transparency on synthetic nature

The user acknowledges that the generated voice is a synthetic reconstruction produced from elements they provided. It does not constitute the deceased's real speech. Generated responses must never be interpreted as the deceased person's actual wishes, decisions, instructions, promises, or authentic messages.

Art. 9 — Limitation of generated content

WIR may limit, block, or refuse the generation of content that could harm the person's dignity or reputation, or that creates confusion or emotional manipulation. WIR may prevent the generation of financial, legal, medical, testamentary, political, or contractual messages in the name of a deceased person.

Art. 10 — Prohibition of impersonation and deception

It is strictly prohibited to use a reconstructed voice to make a third party believe the deceased is alive, is actually speaking, or is validating an act. Any deceptive, fraudulent, or malicious use results in immediate account suspension and deletion of the relevant content.

Art. 11 — Right to deletion

The user may at any time request the deletion of the reconstructed voice, uploaded audio files, and associated generated content. WIR may also delete these elements in case of violation of these terms, serious family challenge, or manifest risk of dignitary harm.

Art. 12 — Data provided by the user

The user is solely responsible for the audio files, photos, texts, and information they provide. They guarantee having the necessary legitimacy to use them in a private context and commit not to transmit content obtained fraudulently or contrary to the known wishes of the person concerned.

Art. 13 — Emotional protection

WIR reminds users that voice reconstruction of a deceased person can have a significant emotional impact. This service is designed as a memory and transmission tool, not as a substitute for the deceased or a medical/psychological support. WIR recommends measured and conscious use, and encourages users to consult a health professional if usage becomes a source of emotional dependency.

Art. 14 — Prohibition for public figures and minors

Voice reconstruction of public figures (artists, politicians, athletes, etc.) is strictly prohibited without express authorization from rights holders. Voice reconstruction of a deceased child is subject to a reinforced framework and requires the agreement of both parents or legal guardians, given the particular sensitivity of this situation.

Art. 15 — Commercial or public use prohibited

Any public, commercial, promotional, artistic, media, or professional use of a reconstructed voice is prohibited without prior, specific, and verifiable authorization from rights holders. WIR may require additional documentation or refuse such use at its sole discretion.

Art. 16 — Preventive suspension

WIR reserves the right to suspend or refuse the creation of a reconstructed voice when a use appears ambiguous, conflictual, disrespectful, or contrary to the spirit of the service. This suspension may occur without notice in case of risk to the person represented, their relatives, or the platform.

Art. 17 — Retention of vocal data

Audio files and reconstructed voices are retained for the duration of the user's active account. Upon account deletion, this data is erased within 30 days. The user may request early deletion at any time via support.
